Legal	Terms and Conditions of Use Important: These terms are your ("You/Your") agreement with The New World Assembly Limited ("Us/We/Our") and cover your use (your Subscription) of our servers and services ("Service"). 1. Your use of the Service 1.1 By accepting these terms you represent that: (a) the information You provide when creating Your Subscription is complete, current and accurate; (b) that You are responsible for all other standard charges payable to Your internet service provider; (c) if under the age of 18 You have the permission of a parent of guardian to use the Service and set up a Subscription and use the credit card or other payment mechanism used by You to subscribe to the Service; (d) You will use the Service in accordance with these Terms and will under no circumstances change any server slots from that paid for in Your Subscription or remove the passwords provided to You from a private server to a public server; (e) You will not do anything which may adversely affect the availability or performance of the Service, or any aspect of it, either with that intention or with reason to believe that this is likely to be the result; (f) You will not use the Service in: (i) an anti-social manner; (ii) or any manner which may reasonably be considered misleading, inaccurate, discriminatory, racial, defamatory, indecent, threatening, libellous or obscene or otherwise objectionable; (iii) or an infringement of any persons Intellectual Property Rights; (iv) any manner which is illegal or to promote illegal activities or pirating software; (v) any manner to harm third party services or the Service; (vi) to introduce viruses or other destructive computer code, spam or other advertising and promotional material; (vii) or to interfere with any third party systems or users or otherwise infringe the reputation of Us and our third party providers and sponsors, the other users of the Service or the Service. You are solely responsible for all content provided by Your User of the Service and You acknowledge that We shall not be responsible for any use of the Service by a third party which breaches this provision of the Terms; (g) You will not avoid or circumvent any feature of the Service which is intended to protect the security or privacy of the Service or any material or information in it, or restrict access to these nor must you attempt to do so; (h) You will keep your Subscription access details secret and secure. You are accountable for any use of Your account by anyone who has obtained access with Your permission or as a result of Your failure to keep Your password secret and secure; or (i) You must not allow anyone else to use Your access the Service or charge anyone for using the Service. You must not present the Service, or any material obtained through it, as part of any other facility or service. You must not use someone else's account or password to access the Service without their permission. 1.2 In return for Your acceptance of these Terms, and Your compliance with them, You may use the Service for the duration of Your Subscription in connection with Your permitted use of the Service. You may not use the Service in any other way, or for any other purpose. 1.3 Customer Support: We shall provide to You customer support in relation to the Service. Please contact Us on the dedicated email address or telephone numbers provided to You. We hope to resolve Your query as soon as is reasonably practicable. 1.4 You give Us permission to use features to monitor Your use of the Service. 2. Limited warranty - Indemnity 2.1 We do not give any assurance regarding the Service other than those explicitly stated in these Terms and any which would otherwise be implied are excluded. 2.2 We do not exclude or restrict any liability for: any personal injury resulting from negligence; under Part 1 of the Consumer Protection Act 1987; under Section 2 of the Supply of Goods and services Act 1982; and for fraud. 2.3 You shall indemnify Us against any and all claims, damages, actions, liabilities, costs and expenses including reasonable lawyer's fee and expenses arising out of Your breach or non-observance of these Terms. 2.4 Our liability to You under these Terms and the provision of the Service is limited to the fees paid by You for the Service. 3. Privacy and Data Protection 3.1 You give Us permission to acquire your personal information and to use it and share it for the purposes of operating and providing the Service. 3.2 You give Us permission to contact you by e-mail or other means in connection with the Service or any other products or services which We or our commercial associates may offer from time to time. This includes contacting you for the purposes of promoting those products and services. In the event that you do not wish to be contacted for such purposes, please send us with an email to the dedicated email address to unsubscribe. 4. Cancellation/Ending your Subscription 4.1 Cancellation: If you are an individual, rather than a company, You may cancel your Subscription within 14 days of accepting these terms or only before the supply of the Service by Us, whichever occurs the earliest. To cancel, you must inform Us on the dedicated email address provided to You. You will lose your right to cancel if You begin using the Service. 4.2 We may suspend or end your subscription immediately or by giving some days of notice (at our choice) by giving you a notice by email to the email address provided by you. If you change your email address you must notify Us immediately otherwise any notice to you email address initially provided will be deemed satisfactory notice. 4.3 In the event that We reasonably end or suspend your Subscription: (a) for routine maintenance or short periods of downtime of the Service (for which We shall try to give You notice but this may not always be possible); (b) as a result of your misuse of the Service or breach of these Terms; You will not be entitled to a refund. 4.4 You may only end Your Subscription in accordance with your statutory rights and in the event that You do not accept any Terms amended in accordance with Paragraph 5.5 of these Terms below. 4.5 When your Subscription ends the permission given in Paragraph 3.2 shall continue and Our obligations to provide the Service come to an end. 5. General 5.1 Your Subscription to the Service and these Terms are subject to English law. Any issue concerning or arising out of the Service, Your use of it, Your Subscription or these Terms is to be decided by the English courts. 5.2 We may assign Our rights and delegate Our obligations under these terms, but You may not assign any of Your rights or delegate any of Your obligations and You must not attempt or purport to do so. 5.3 We are not in breach of these terms, or otherwise liable to You, for failing to fulfill any of Our obligations under these terms to the extent this is due to Your own acts or omissions or any cause beyond Our reasonable control. 5.4 We, our commercial associates, and any users of the Service may rely on the permissions You have given, but apart from this only You and Us may enforce any aspect of these terms. 5.5 The Terms of your Subscription or these Terms may only vary with an agreement between You and Us. We may vary these Terms by sending you an email of the variation which will deemed to be accepted by You after 15 days of receipt of the amendment by Your continuation to use the Service.
